Hereinafter \u201cthe Seller\u201d.<\/p>\n<p><strong>Buyer.<\/strong> Any person, whether a professional or a consumer, making a purchase via the website is hereinafter referred to as \u201cthe Buyer\u201d. They apply in mainland France and in the countries to which the Seller may make sales and deliveries.<\/p>\n<p>Any order implies full and complete acceptance of these GCS by the Buyer, who declares having read them before confirming their order. Without such acceptance, the order cannot be confirmed.<\/p>\n<h2 id=\"article-2-products\">Article 2 \u2014 Products<\/h2>\n<p>The descriptions and characteristics of the products presented on the website are provided for information purposes only. The Seller reserves the possibility of making changes to them, provided that the essential characteristics of the product are not affected.<\/p>\n<p><strong>Fire safety and fire classification.<\/strong> The reaction-to-fire classification (for example M1) is obtained only when the product is applied in accordance with the prescribed method (in particular, application until saturation and run-off) and on the materials and weights (g\/m\u00b2) covered by the classification test report in force. It is the Buyer\u2019s responsibility to check that their substrate falls within the validated scope. For any use in an establishment open to the public (ERP), the final compliance of the installation is assessed, project by project, with the inspection body or the competent safety commission. The Buyer is invited to carry out a preliminary test and to follow the instructions for use provided.<\/p>\n<p><strong>Chemical products.<\/strong> Some products are liquids classified as hazardous under the CLP Regulation (notably flammable). The Buyer undertakes to comply with the labelling, the precautions for use and the safety data sheet (SDS) made available. The transport of these products is subject to the regulations applicable to dangerous goods.<\/p>\n<h2 id=\"article-3-prices\">Article 3 \u2014 Prices<\/h2>\n<p>Prices are expressed in euros. They are displayed on the website excluding tax (excl. tax) and including all taxes (incl. tax). The price excl. tax does not include VAT, delivery costs or any bank charges, which are added to the price and indicated before the order is confirmed. The total amount payable by the consumer is the amount incl. tax, delivery costs included.<\/p>\n<p>For deliveries outside France, invoicing may be made excluding tax, in which case VAT and any duties and taxes are payable by the Buyer in the delivery territory.<\/p>\n<p>Prices, quotes and proposals are valid for one month. The prices shown on a purchase order registered on the website are binding on the parties.<\/p>\n<h2 id=\"article-4-orders\">Article 4 \u2014 Orders<\/h2>\n<p>An order is only definitively recorded if the Buyer is clearly identified and payment is confirmed, whether the order is placed on the website, by email or by telephone. The Seller reserves the right to refuse any order from a Buyer with whom a payment dispute is ongoing, or who has not paid for a previous order.<\/p>\n<h2 id=\"article-5-payment-retention\">Article 5 \u2014 Payment and retention of title<\/h2>\n<p>Payment is made by bank card or bank transfer. The Buyer warrants that they hold the necessary authorisations for the payment method used. If authorisation is refused or payment is not made, the Seller may suspend or cancel the order and its delivery.<\/p>\n<p><strong>Retention of title.<\/strong> In accordance with French Law No. 80-335 of 12 May 1980, the Seller retains ownership of the goods until full payment of the price. If payment is not made, the Seller may repossess them; the risks and costs of repossession are borne by the Buyer. The Buyer bears responsibility for the goods delivered and the risks of loss or damage from the time they are handed over, subject, for consumers, to the rules on the transfer of risk set out in Article 6.<\/p>\n<p><strong>Late payment.<\/strong> For professional Buyers, any late payment automatically gives rise to penalties calculated at the increased statutory interest rate (or at the agreed contractual rate), a fixed compensation of \u20ac40 for recovery costs (Articles L441-10 and D441-5 of the French Commercial Code) and, where applicable, additional compensation. For consumer Buyers, sums due bear interest at the statutory rate.<\/p>\n<h2 id=\"article-6-delivery\">Article 6 \u2014 Delivery<\/h2>\n<p>Delivery takes place after confirmation of payment. Shipping and delivery times are given for information purposes only; a delay cannot give rise to compensation or justify cancellation, subject to the consumer\u2019s rights under Article L216-6 of the French Consumer Code. Deliveries may be partial or complete.<\/p>\n<p><strong>Transfer of risk.<\/strong> For consumer Buyers, the risk of loss of or damage to the products passes at the moment the consumer (or a third party designated by the consumer, other than the carrier) takes physical possession of the products (Article L216-4 of the French Consumer Code). For professional Buyers, the products travel at the consignee\u2019s own risk from the time they are handed over to the carrier.<\/p>\n<p>If a parcel is damaged or opened on delivery, the Buyer must refuse it or record precise reservations with the carrier, and inform the Seller on +33 1 40 20 02 96 or at info@alfaflor.com as soon as possible.<\/p>\n<p>The Buyer confirms the accuracy of the delivery address provided. In the event of absence at the time of delivery or if the collection deadline at a parcel relay point is exceeded, an administrative fee of \u20ac9.90 excl. tax may be charged, in addition to new shipping costs.<\/p>\n<h2 id=\"article-7-right-withdrawal\">Article 7 \u2014 Right of withdrawal (consumers)<\/h2>\n<p>In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer Buyer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give reasons for their decision.<\/p>\n<p>To exercise this right, the consumer notifies their decision by an unambiguous statement (letter or email to info@alfaflor.com), where applicable using the model withdrawal form. The products must be returned no later than 14 days after this notification. Return costs are borne by the Buyer.<\/p>\n<p><strong>Exception to the right of withdrawal \u2014 sealed chemical products (Article L221-28, 5\u00b0, of the French Consumer Code).<\/strong> The liquid fire retardants sold on the website are chemical mixtures falling under Regulation (EC) No 1272\/2008 (CLP), delivered in a sealed container whose labelling guarantees the composition. Once the container has been unsealed, the integrity and composition of the mixture can no longer be verified or guaranteed; the product can then neither be repackaged nor placed back on the market without risk to the health and safety of users. In accordance with Article L221-28, 5\u00b0, of the French Consumer Code, the right of withdrawal therefore cannot be exercised for a chemical product unsealed after delivery. It remains fully applicable to products returned still sealed, in their original intact container, and to non-chemical items.<\/p>\n<p><strong>Condition of returned goods (Article L221-23 of the French Consumer Code).<\/strong> As the Seller has informed the consumer Buyer of their right of withdrawal in accordance with Article L221-5, the Buyer is liable only for any depreciation of the goods resulting from handling other than that necessary to establish their nature, characteristics and proper functioning. The nature and characteristics of a chemical product are assessed without opening the container; opening it goes beyond these checks and, as the product cannot be placed back on the market, results in a depreciation equal to its value.<\/p>\n<p>Where the right of withdrawal is validly exercised, the Seller refunds the sums paid, including standard delivery costs, no later than 14 days after being informed of the decision; the refund may be deferred until the products have been recovered or proof of their dispatch has been provided.<\/p>\n<h2 id=\"article-8-legal-guarantees\">Article 8 \u2014 Legal guarantees<\/h2>\n<p><strong>Legal guarantee of conformity.<\/strong> The consumer Buyer benefits from the legal guarantee of conformity provided for in Articles L217-3 et seq. of the French Consumer Code. They have a period of two (2) years from delivery of the goods to take action; they may choose between repair and replacement, subject to the cost conditions laid down by law, and are exempt from proving the existence of the lack of conformity during the 24 months following delivery.<\/p>\n<p><strong>Guarantee against hidden defects.<\/strong> The Buyer also benefits from the guarantee against hidden defects in the item sold (Articles 1641 et seq. of the French Civil Code), enabling them to obtain the rescission of the sale or a reduction of the price, within two years of discovering the defect.<\/p>\n<p>These legal guarantees apply independently of any commercial guarantee that may be offered. To exercise them, the Buyer may contact the Seller at info@alfaflor.com.<\/p>\n<h2 id=\"article-9-liability\">Article 9 \u2014 Liability<\/h2>\n<p>With regard to the products sold, the Seller is bound by an obligation of means (best-efforts obligation) as to the advice and information provided. The performance of the treatment (including the fire classification) depends on the actual conditions of application, the nature of the substrate and compliance with the instructions for use; it is the Buyer\u2019s responsibility to ensure that the product is suitable for their needs and, where applicable, to have its use validated by the competent authority.<\/p>\n<p>The Seller cannot be held liable for damage resulting from use not in accordance with the instructions for use, incorrect application, or use of the product on a substrate outside the validated scope. The Seller\u2019s liability cannot be incurred for damage related to the use of the internet (intrusion, viruses) or arising from force majeure.<\/p>\n<p><strong>Public policy reservation.<\/strong> No provision of these GCS shall exclude or limit the Seller\u2019s liability in the event of personal injury, gross negligence or wilful misconduct, or in respect of liability for defective products (Articles 1245 et seq. of the French Civil Code) or the legal guarantees, in accordance with the applicable public policy provisions.<\/p>\n<h2 id=\"article-10-control-batch\">Article 10 \u2014 Control and batch label<\/h2>\n<p>The Seller affixes to its products a control and batch label ensuring their traceability. Subject to the statutory rights of the consumer Buyer (right of withdrawal and legal guarantees), altering or removing this label may preclude an exchange offered as a commercial gesture.<\/p>\n<h2 id=\"article-11-personal-data\">Article 11 \u2014 Personal data<\/h2>\n<p>The personal data collected when an order is placed are necessary for its processing and are processed in accordance with Regulation (EU) 2016\/679 (GDPR) and the French Data Protection Act (loi Informatique et Libert\u00e9s). The Buyer has a right of access, rectification, erasure, objection and portability, which they may exercise at info@alfaflor.com. For further details, please refer to the website\u2019s privacy policy.<\/p>\n<h2 id=\"article-12-governing-law\">Article 12 \u2014 Governing law and disputes<\/h2>\n<p>These GCS and the sales resulting from them are governed by French law. In the event of a dispute with a consumer Buyer, the latter may refer the matter, at their choice, to one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or to the court of the place where they resided at the time the contract was concluded or the harmful event occurred.<\/p>\n<p>Where the Buyer has the status of a merchant, any dispute falls within the exclusive jurisdiction of the Paris Commercial Court, notwithstanding multiple defendants or third-party claims.<\/p>\n<p><em>Last updated: 20 August 2026.
